Can You Install an EV Charger in a Maryland Apartment or Condo?

Maryland has laws protecting condo and HOA residents who want to install EV chargers. Here's what your rights are and how to make it happen.

Maryland's EV Charging Access Law

Maryland passed legislation that prohibits HOAs and condo associations from unreasonably restricting EV charger installation. Under the Maryland Condominium Act and the Homeowners Association Act, associations must permit owners to install EV chargers in their exclusive-use parking spaces, provided the installation meets reasonable safety and aesthetic standards. Associations can require the owner to use a licensed electrician, obtain permits, and maintain liability insurance — but they cannot simply say no.

What's Realistic in a Condo Building

In condos with assigned parking spaces that have direct access to a circuit panel — rare but it happens in newer buildings — individual installation is feasible. More commonly, the building's electrical infrastructure isn't set up for individual tenant circuits in parking areas. In these cases, the HOA or condo board needs to invest in a shared charging infrastructure with load management.

How to Approach Your HOA

Start by reviewing your condo declaration and HOA rules for any existing EV charging language. Then submit a written request to the board citing Maryland law. Offer to use a licensed electrician, pull all required permits, and add the installation to your homeowner's policy. Most boards, once they understand the legal framework, will approve a reasonable request. We can provide documentation to support your HOA application.

Apartment Renters

Renters have fewer rights under Maryland law, but the landscape is improving. Several Maryland counties are considering renter EV charging access requirements. For now, the best approach is to discuss the need with your landlord — some are willing to install a NEMA 14-50 outlet with cost shared between tenant and landlord. You can also advocate for shared building charging if your apartment has common parking.
